David A. Loglisci is a partner at Forchelli Deegan Terrana LLP and concentrates his practice in construction, commercial and general civil litigation. Mr. Loglisci has over 25 years of litigation experience, including trials in both the state and federal courts, as well as arbitrations. He also has successfully argued numerous appeals.
Mr. Loglisci recently obtained a reversal of the Supreme Court and reinstatement of a multi-million-dollar construction delay lawsuit against a New York City agency, despite “no damage for delay” and two-day notice-of-delay clauses in the contract.
In addition to representing owners, general contractors and subcontractors, Mr. Loglisci has counseled and represented clients in a broad range of legal matters, including cases involving the Uniform Commercial Code (Sale of Goods and Leases), breach of contract, mechanic’s liens, business litigation, non-compete litigation, fraud, breach of fiduciary duty, property damage, trespass and nuisance, among others. He also has successfully represented numerous equipment lessors in obtaining possession of leased equipment and recovering money owed by lessees, and has successfully prosecuted several cases on behalf of clients whose buildings were severely damaged by construction work performed at adjacent premises. Mr. Loglisci has obtained injunctions stopping any further construction work and has recovered substantial sums for his clients.
Mr. Loglisci is admitted to practice before the New York State Bar and the United States District Court for the Eastern and Southern Districts of New York. He is a member of the Nassau County Bar Association, where he serves on the Commercial Litigation and Appellate Practice Committees, and served as co-chair of the Creditors’ Rights Law Committee of the Suffolk County Bar Association. Mr. Loglisci is also Immediate Past President of the Columbian Lawyers Association of Suffolk County.
